TERMS AND CONDITIONS OF THE CONTRACT
DISTANCE SELLING CONTRACT - WATCHES
GENERAL ASPECTS
Time Broker - is the trade name of S.C. Licitatie Online SRL, a Romanian legal entity, headquartered in Bucharest, Strabuna Street, no. 133, registered under the Trade Registry with no. J40/13822/2023, fiscal registration code 48541612, phone: +40784280048.
ORDER PLACEMENT
Orders can be placed through private messages on Olx, by phone at +40784280048, or directly from the online store magazin.amanet.ro. Orders are accepted from Monday to Friday, between 09:00 and 17:00, and on Saturday from 09:00 to 13:00, excluding legal holidays.
ORDER CONFIRMATION
Order confirmation will be done on the same platform where the order was placed (Olx, phone, Facebook), except for orders from the online store, where confirmation will be sent via email. The average delivery time is 2-4 working days, calculated from the moment the delivery confirmation message is sent to the customer.
PAYMENT METHODS
When purchasing from our website, you can choose the following payment methods:
4.1. Online payment by credit card
To buy products online with credit card payment:
a. Select the product you want to purchase and click "Add to cart," then follow the steps to complete the order until you reach the payment method selection. After selecting the "Online payment by credit card" option, accepting the terms and conditions of S.C. Licitatie Online SRL, and clicking the "Submit order" button, you will be redirected to the online payment processor to enter your credit card details.
b. Enter your personal information
This information is necessary for the correct and efficient processing of your order. Personal data entry is done using an SSL encrypted connection. Be sure to fill out the form correctly and provide delivery and billing details.
c. Enter credit/debit card details:
For payments with Visa and MasterCard credit/debit cards (Visa/Visa Electron and Mastercard/Maestro), the "3-D Secure" system is used, providing online transactions with the same level of security as ATM or physical transactions. If the card transaction is successful, you will be redirected to our website. You will receive payment confirmation from mobilPay via email and order confirmation from us.
TRANSPORTATION AND DELIVERY OF GOODS
The Seller undertakes to deliver the goods through door-to-door courier service to the Buyer.
The Seller will ensure proper packaging of the goods and the transmission of accompanying documents (physically or by email).
Product delivery to the customer is carried out through a rapid courier service. Deliveries are generally made within 2-4 working days from the seller's dispatch confirmation. The delivery term is guaranteed by the courier company from the moment the order is confirmed.
The Seller is responsible for the accuracy of the information entered on the AWB (Air Waybill). The AWB number is the transport document number and is found on the printed document next to the barcode. It is a unique identification code that allows the customer to locate the parcel in real-time.
For faster receipt of the parcel, the customer can request pickup from the courier company's office/branch in the delivery location by contacting the courier company's representative at the phone number displayed on the courier's website.
If the customer is not found within 2-3 days at the provided delivery address, S.C. Licitatie Online SRL reserves the right to cancel the order.
The transportation cost for returns (including returns for warranty service during the warranty period) is borne by the buyer. Post-warranty service is not provided.
BILLING AND PAYMENT METHOD FOR PRODUCTS AND TRANSPORT
The prices of goods are displayed on the online sales websites, including VAT, and are non-deductible according to current legislation, namely Article 152² of the Fiscal Code.
The Seller will issue an invoice to the Buyer for the delivered goods, and the Buyer is obliged to provide all the necessary information for invoicing in accordance with the current legislation.
The Seller will send the Buyer the invoice for the order in written form, containing the value of the goods sold by S.C. Licitatie Online SRL. The invoice will be sent with the parcel, along with the purchased product (together with the supplied accessories) and the warranty certificate.
The AWB also includes a packing list, specifying the contents of the package (purchased item/s, relevant invoice, and accessories of the item/s).
For proper communication of the invoice related to the order, the Buyer is obliged to inform the Seller of any changes to their details and address, as well as the IBAN code in the case of returns.
The billing of purchased products is exclusively in RON.
PRODUCT RETURNS
We want our products to fully meet your quality requirements. If you are not satisfied with the purchased products, you can contact us for a return within 14 calendar days, and we will refund the value of the products you paid for. Romanian legislation states: "The consumer has a period of 14 days to withdraw from a distance contract, without being obliged to justify the decision to withdraw."
Our customers can return purchased products in their physical and functional condition from the moment of delivery, in their original packaging with accessories, warranty certificate, invoice, and this document (terms and conditions), all in original, within 14 calendar days from receipt, without invoking any reason, by notifying this return in advance, by phone or by message at +40784280048.
Product returns will be exclusively at the expense of the customer, using only the services of a rapid courier, with the option of opening the package upon delivery by the seller's representative. S.C. Licitatie Online SRL will refund the order value specified on the invoice within a maximum of 14 calendar days from the date of receiving the sold and returned goods. The refunded amount to the customer does not include transportation costs, cash-on-delivery charges, and bank commission. The return transport cost is different for each rapid courier company, and charges may apply for additional kilometers or kilograms.
- CONDITIONS FOR RETURNING A PRODUCT
The Buyer will contact a representative of S.C. Licitatie Online SRL, to whom they will provide information about the product they want to return. The return is only through rapid courier companies. The return is made within 14 calendar days from receiving the product. S.C. Licitatie Online SRL will refund the order value within a maximum of 14 days from the date of receiving the sold and returned goods, by Bank Transfer. For this, S.C. Licitatie Online SRL will request the customer's IBAN code, consisting of 24 characters, and the full name of the account holder.
In the case of returns, transport costs are borne by the buyer, who must personally pay the transport cost to the courier company returning the product. Bank transfer commissions representing the value of the returned products are borne by the buyer. The right of return within 14 calendar days applies only to customers who have purchased products sold by S.C. Licitatie Online SRL and posted on online sales websites.
Returned products must meet the following conditions:
- Returned products must be accompanied by the supplied accessories and purchase documents: warranty certificate, invoice, terms and conditions document, all in original;
- Returns are not accepted for products showing signs of damage (other than those stated in the warranty certificate) or not matching the identification/serial numbers provided on the purchase documents.
- All products to be returned must be in the same condition as when delivered. Products on which unauthorized interventions have been made, which have been damaged, show signs of wear or excessive use, scratches, chips, dents, mechanical/electrical shocks, cannot be accepted. Also, products not accompanied by all supplied accessories are not accepted.
- In any situation, before returning the products, the buyer must ensure that:
- They are not protected by passwords set by the buyer;
- Any accounts defined by the buyer have been deleted;
- Operating systems or other programs delivered with the product have not been uninstalled;
- No other unauthorized interventions have been made that would lead to modifications of the software from the initial state in which the product was delivered.
S.C. Licitatie Online SRL has an entire team dedicated exclusively to the quality of products. Thus, you have the guarantee that the ordered products are in good condition, fully functional, and do not change their attributes and functional characteristics with proper use.
However, in the event that the sent item is damaged (due to the seller's fault) and is subject to warranty, the customer will be refunded. S.C. Licitatie Online SRL does not accept cash-on-delivery parcels!
WARRANTIES
All goods sold by S.C. Licitatie Online SRL benefit from warranty conditions in accordance with current legislation, specific to second-hand goods. Our company sells second-hand products (they are not new) that comply with all commercial conditions, presenting normal quality and performance parameters that the consumer can reasonably expect, given the nature and characteristics of the product. For goods sold and delivered by S.C. Licitatie Online SRL through couriers, the buyer will receive a warranty certificate for each item upon delivery, with all details and conditions of application, as well as the purchase invoice and the supplied accessories of the product, if any. During the 14 calendar days (from the date of product acquisition), representing the warranty period, S.C. Licitatie Online SRL will provide service for defects not attributable to the customer. In this case, the cost of transportation will be borne by the customer (round trip). If, upon receipt of the product for service, it is found that the defect is not attributable to the customer, and the product can no longer be used, the customer will be refunded, and the value of the item will be reimbursed within 14 calendar days from the date of finding and communicating the defect to the customer. In this case, the cost of transportation will be borne by the customer. Post-warranty service is not provided!
TRANSFER OF OWNERSHIP OF GOODS
Ownership of the goods will be transferred upon delivery, after payment by the buyer in the location indicated in the order (understanding by delivery - signing the transport document provided by the courier).
DISCLAIMER
S.C. Licitatie Online SRL cannot guarantee the availability of all displayed products in stock. For this reason, S.C. Licitatie Online SRL reserves the right not to honor the order if the respective product is no longer available in the current offer. Any complaints will be transmitted to S.C. Licitatie Online SRL within 24 hours of receiving the products (by email at office@timebroker.com or by phone at +40784280048, and it will be forwarded for resolution.
